Advocate Privacy Policy

Welcome to Advocates! Our website, located at adv.gg and its related subdomains (the “Site”), as well as the related platform for brands and broadcasters to connect for and execute live streaming campaigns (the “Service”) owned and operated by [Advocates, Inc.] (“Advocates,” “we,” “us,” or “our,” as used in this Policy). This Privacy Policy explains how we collect, use and share information gathered from visitors to our Site, Brand representatives, and Broadcasters (“you,” “your, or “users” as used in this Policy).

You can use the Site and Services in three ways:

  • As a visitor to the website (collectively, “Visitors”)

  • As an agent of a brand seeking to place ads on live stream content (collectively, “Brands”)

  • As a broadcaster and influencer seeking to support campaigns of one or more Brands (collectively, “Broadcasters”)

What We Collect

We may collect information from you when you when you visit the Site and when you sign up for the Service as a Brand or Broadcaster.

When you visit the Site, we may log and store your IP Address and technical information about your visit like your browser type and other common analytics information, such as Google Analytics (“Site Usage Information”). If you visit from a mobile device, Site Usage Data may reference your device or other information about where your visit originated.

Our Site uses session cookies to maintain your logged-in status. A cookie is a small piece of software on your computer to help us record your login ID and password. This cookie expires in 30 minutes if you do not check the "Remember Me" box when logging in. It expires after 1 year if you do check the "Remember Me" box. You can remove this and other cookies through your browser preferences menu, though the exact method varies depending on the type of browser you use.

Our Service allows Brands to advertise through Broadcasters with various text and other media (“Assets”) on video streaming platforms, including Twitch. The Service uses the Twitch API, from which the Service retrieves certain information about the display or and interactions with Assets displayed at the request of a Brand in a “Campaign”, each of which may relate to a Broadcaster’s Twitch Account (collectively, “API Data”). API Data might include information about the referrer headers of particular Asset clicks, Asset impressions, the performance of a Campaign overall in different segments, geographies, or groups, and the chat stream relating to an Asset display.

Also, as a Broadcaster, we collect information about your Twitch account that allows us to use this API. Together with the profile information you enter directly onto the Site as a Broadcaster, we call this “Broadcaster Data”. As a Broadcaster, we collect your Twitch username, avatar, and the email you have registered with. The information entered by a Brand and/or its agents on the Site to create a Services Account is “Brand Data.” Each of these types of data may be related to an IP Address or Site Usage Information on our systems.

For Broadcasters, we manually collect your payment information in order to compensate you for your role in the Services. For Brands, you will provide payment account information to pay service fees via ACH or Paypal. In each case, the information provided to us to process payments is referred to as “Payment Information” in this Policy. We collect payment information manually, including over the phone or email by specific request to a Broadcaster or Brand agent. We store this information in a password-protected file local in our cloud storage. We retain it for as long as you have an active service relationship with us, and for up to one year afterward.

How We Use It

We process your data, including personal information, based on your consent to our Terms of Service and/or your instruction to become a user of the Services.

Site Usage Data helps us monitor aggregate metrics such as total number of visitors, traffic, usage, and demographic patterns on our Site, diagnose or fix technology problems, and otherwise plan for, improve and enhance our Site or our business operations.

We use API Data, with reference to Brand Data and Broadcaster Data relating to a particular Asset, to derive custom analytics about the performance and activity of Campaigns, Assets, Brands, and Broadcasters. This information is collectively used to administer Campaigns, prepare reports of Campaigns and Assets for Brands, and compensate Broadcasters. We may also use these types of data, collectively, to report on campaign analytics and make recommendations for how to launch more effective campaigns in the future.

Payment Information is used to effect your payment for advertising services, as a Brand, and is used to remit fees to you, as a Broadcaster.

Sharing of Your Information

In the course of obtaining API Data, we share Broadcaster Data with Twitch to verify account status and log Campaign-related activity on Twitch. We may generate and share aggregate, anonymous information about the performance of certain types of Assets and/or Campaigns, or all of the Assets and Campaigns, in the Service with the general public as a part of our marketing efforts.

We may use Brand data or Broadcaster Data to contact the applicable Brand or Broadcaster and maintain your account on the Service. Each type of account data, as well as API Data, may be stored in whole or in part on cloud servers hosted by third parties. These third party cloud services that provide us with hosting and other technical infrastructure. We store API Data for Campaigns, as well as Broadcaster and Brand Data relating to those campaigns, for a standards 6 months, with limited exceptions.

The third party service OAuth 2.0 is used to authenticate Broadcasters’ Twitch accounts for third party sites like ours. Find details about how this works here.

We may share Site Usage Data with our third party service providers in the course of our operations in order to operate and maintain our Site. We may also engage third parties to help us improve our business, such as analytics providers, and such parties may have access to aggregate or individual Site Usage Data.

Third Party Sharing. In the ordinary course of our business we may also share personally-identifiable information (“PII”) contained in Brand Data, Broadcaster Data, or API Data as follows:

  • We may share PII with our affiliates (meaning entities controlled by, controlling or under common control with us). You are consenting to this sharing. We may combine information internally across different parts of our Service.

  • We may share PII to carry out your instructions (for example, to process payment information) or unless we have your separate consent.

  • We may share PII where we have a good faith belief that disclosure is permitted by law or is reasonably necessary to: (1) comply with a legal requirement or process, including, but not limited to, civil and criminal subpoenas, court orders or other compulsory disclosures; (2) enforce this Privacy Policy or our Terms; (3) respond to claims of a violation of the rights of third parties; (4) respond to Member service inquiries; or (5) protect the rights, property, or safety of Advocates, our Services, our Brands, Broadcasters, Site visitors, or the public.

  • We may share PII with our third party vendors (such as a cloud hosting provider or security service) where such sharing is necessary for us to optimize, secure, or deliver the Services to you.

  • We may use (and in the course of using allow access by third parties to) information and content that you and other users of the Service provide to us to conduct research and development for the improvement of our Service, in order to provide you and others with a better experience and drive membership growth and engagement on our Service.

Security of your Information

We care about the security of your information and use commercially reasonable physical, administrative, and technological safeguards to preserve the integrity and security of all information we collect and, in some cases, share with our service providers. Because of the nature of our Site and Services, we use Secure Socket Layer technology and HTTPS to transmit information between our Site, Advocates, and our cloud infrastructure providers. We do not control, the architecture or security of the Twitch API, and you should refer to the Twitch Privacy Policy for more details about how Twitch and its services’ data handling practices. IF YOU ARE UNCOMFORTABLE WITH THE TRANSMISSION OF THE INFORMATION DESCRIBED HEREIN, PLEASE DO NOT SUBMIT INFORMATION TO US THROUGH THE SITE OR SERVICES.

While we take reasonable precautions against possible security breaches, no website or internet transmission is completely secure and we cannot guarantee that unauthorized access, hacking, data loss or other breach will never occur. In the event that any information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and where appropriate, notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations.

Your activity on the Site does not allow us to recognize or acknowledge Do Not Track signals, though our registration process and services are secured according to specific contractual promises. Do not transmit any sensitive or personal information using the Site other than as directed to create an account on the Platform.

Third Party Links

The Site may, from time to time, contain links to and from third party websites. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for their policies. Please check the individual policies before you submit any information to those websites.

Your California Privacy Rights

California Civil Code Section 1798.83, known as the “Shine The Light” law, permits our customers who are California residents to request and obtain from us a list of what personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year and the names and addresses of those third parties. Requests may be made only once a year and are free of charge. Under Section 1798.83, we currently do not share any personal information with third parties for their direct marketing purposes.

Children

Minors under 18 are not permitted to use our Site and we do not intentionally collect information from minors under 13. If you believe we have collected any personal information from a child younger than 13 years of age, please notify us immediately at privacy@adv.gg and we will do anything reasonably possible to remove that information from our systems.

Contact Us and Accessing Your Information

You have the right to access information about your account with Advocates and your use of the Services, where in our custody or control. We are not able to provide access to Twitch’s data. Should you have a complaint about our use of your data, you have a right to lodge such complaint with a local supervisory authority in your jurisdiction, such as a Data Protection Authority in the European Union.

Note that we do not have identifying information on file for most Site visitors. We can only remove personal information actually in our possession. If we remove your personal information upon your request, this may inhibit or prevent us from issuing payments, may interrupt any ongoing Campaigns, and will cause you to lose access to Campaign or Account history.

If you do email us at privacy@adv.gg and ask that we remove any information we have stored about you on our systems, we will do so within a reasonable time of receiving your request.

If we make a material (as determined in our sole discretion) update to this policy, we will attempt to notify you of such update via email, or within the Services or Site.
